- Brand Identity Design – Logo design, visual systems, colour palettes, typography, and brand guidelines.
- Content Marketing – Captions, blogs, carousels, email campaigns, and storytelling content.
- Brand Consulting – Strategy sessions, audits, and marketing direction for growing businesses.
All services are delivered digitally. We do not deliver physical goods of any kind.
3. Eligibility
By using this Website or purchasing our services, you represent and warrant that:
- You are at least 18 years of age.
- You have the legal capacity and authority to enter into a binding agreement.
- You are not barred from receiving services under the laws of India or any other applicable jurisdiction.

4. Service Engagement and Orders

All service engagements begin with a discovery call or written proposal. Once a proposal or scope of work is agreed upon in writing (including via email or WhatsApp), it forms part of the agreement between you and Brandkeymedia.
4.2 Payment to Commence Work
Work on any project will only commence upon receipt of the agreed advance payment or full payment as specified in the proposal. We reserve the right to delay or withhold delivery until payment is confirmed.
4.3 Scope of Work
Any changes to the agreed scope of work will be treated as a separate engagement and may attract additional charges. We will always communicate such changes to you before proceeding.
4.4 Timelines
We make every reasonable effort to deliver services within agreed timelines. However, delays may occur due to factors outside our control, including delayed approvals, feedback, or content from the client. We will not be held liable for delays caused by client inaction.
5. Pricing and Payment
5.1 Pricing
All prices for our services are quoted in Indian Rupees (INR) unless otherwise stated. Prices are exclusive of applicable taxes (including GST) unless explicitly mentioned.
5.2 Payment Methods
We accept payments via online payment methods including UPI, net banking, credit card, debit card, and other methods available through our payment gateway partners (Razorpay, Cashfree, or similar RBI-authorised payment aggregators).
5.3 Advance Payment
For project-based work, we typically require 50% advance before commencing and the remaining 50% before final delivery. For monthly retainer services, payment is due at the beginning of each billing cycle.
5.4 Late Payment
In the event of non-payment or delayed payment, Brandkeymedia reserves the right to pause or suspend work until full payment is received. Repeated non-payment may result in termination of the service agreement.
5.5 GST
Where applicable, Goods and Services Tax (GST) will be charged in addition to the service fee as per the prevailing rates under Indian tax law. GST invoices will be issued upon request.
6. Intellectual Property
6.1 Our Intellectual Property
All content on this Website, including text, graphics, logos, images, audio, video, and software, is the property of Brandkeymedia and is protected under applicable Indian and international intellectual property laws. You may not reproduce, distribute, or use our content without our prior written permission.
6.2 Client Ownership of Deliverables
Upon receipt of full and final payment for a project, the intellectual property rights to the specific deliverables created for you (such as logos, social media content, and video edits) will be transferred to you. This transfer applies only to the final approved deliverables and not to any underlying tools, templates, stock assets, or proprietary processes used by Brandkeymedia.
6.3 Portfolio Rights
Unless you expressly request otherwise in writing, Brandkeymedia reserves the right to display work created for you in our portfolio, case studies, social media, and marketing materials for the purpose of showcasing our work.
6.4 Third-Party Assets
Where stock photography, music, fonts, or other licensed assets are used in your deliverables, usage rights are subject to the licensing terms of the respective third-party providers. Brandkeymedia will inform you of any such licensing requirements.
7. Client Responsibilities
You agree to:
- Provide accurate, complete, and timely information, brand assets, and feedback required for us to complete the work.
- Review and approve deliverables within the agreed timeframe. Unreasonable delays in approval may affect project timelines.
- Ensure you have the necessary rights, permissions, and licences for any content, images, or materials you provide to us.
- Not use our services for any unlawful, unethical, or fraudulent purpose.
- Not engage us to create content that infringes third-party intellectual property, is defamatory, obscene, or otherwise illegal.
8. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. We will not disclose your business strategies, financial information, or trade secrets to any third party without your written consent, except where required by law.
9. Revisions and Corrections
The number of revisions included in each service is as specified in your proposal or service agreement. Additional revisions beyond the agreed number will be billed at our prevailing hourly or per-revision rate.
We are not responsible for errors or omissions in content supplied by the client. Where we have made a demonstrable error, we will correct it at no additional charge within a reasonable timeframe.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- Brandkeymedia’s total liability to you for any claim arising out of or in connection with these Terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim.
- Brandkeymedia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption.
- We make no guarantees of specific results from our services, including growth in followers, sales, leads, or engagement. Results vary based on multiple factors beyond our control.
11. Indemnification
You agree to indemnify, defend, and hold harmless Brandkeymedia, its owner, employees, and associates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with:

12. Termination
12.1 Termination by Client
You may terminate a service engagement by providing written notice to us. Termination does not entitle you to a refund of amounts already paid unless specified in our Refund Policy.
12.2 Termination by Brandkeymedia
We reserve the right to terminate or suspend our services to you immediately and without notice if:
- You breach any provision of these Terms.
- You fail to make payment as agreed.
- We determine, in our sole discretion, that continuing the engagement is not feasible or appropriate.
Upon termination, any outstanding amounts for work completed to date become immediately due and payable.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation.
If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
